Specific identity of the critical habitat should be obtained from the text of the designation of critical habitat published in the Federal Register (77FR71041, published 20121228). The GIS files and their associated coordinates are not the legal source for determining the critical habitat boundaries of species described within this dataset. Inherent in any data set used to develop graphical representations, are limitations of accuracy as determined by, among others, the source, scale and resolution of the data. While the Service makes every effort to represent the critical habitat shown with this data as completely and accurately as possible (given existing time and resource constraints), the USFWS gives no warranty, expressed or implied, as to the accuracy, reliability, or completeness of these data. In addition, the USFWS shall not be held liable for improper or incorrect use of the data described and/or contained herein. These GIS data contain stream reaches that were designated as "critical habitat" for the Lower Columbia River (LCR) steelhead Evolutionarily Significant Unit (ESU). The critical habitat is defined in the National Marine Fisheries Service's (NOAA Fisheries) final rule to designate critical habitat for 12 ESUs of Pacific salmon and steelhead. The fish distribution in this data set was compiled from data gathered from the Idaho Department of Fish and Game (IDFG), Oregon Department of Fish and Wildlife (ODFW) and the Washington Department of Fish and Wildlife (WDFW). Additionally, we received comments from the public, federal agencies, and state and tribal salmon co-managers during the rule making process. A detailed description of this process can be found in the following document: Final Assessment of NOAA Fisheries' Critical Habitat Analytical Review Teams For 12 Evolutionarily Significant Units of Pacific Salmon and Steelhead, NOAA Fisheries Protected Resources Division, 2005.-Within the Idaho portion of the ESU, we started with 1:100,000 scale fish distribution from IDFG. We acquired a database from IDFG which they refer to as the BLM Fish Presence Database (IDFG 2003). The data came from an earlier database originally mapped in 1991 based on a Smolt Density Model developed by the Northwest Power Planning Council. Since 1991, IDFG has made some improvements to the data by noting where documented observations have occurred and where suitable habitat is blocked by irrigation withdrawals. However, when we compared the distribution data with GIS data acquired from the Payette National Forest, it was apparent that there was additional data available that would lead to important improvements to the Snake River Basin steelhead distribution. After reviewing the database and after discussions with staff at IDFG, we decided to solicit information about the distribution of Snake River Basin steelhead from the BLM, USFS, and the Salmon River Subbasin Planning Team. More information about the Idaho portion of the data can be found in the documents referenced in the 'Supplemental Information' section.-On the Washington side of the ESU we started with 1:24,000 scale fish distribution data from WDFW. On the Oregon side of the ESU we started with 1:100,000 scale enhanced fish distribution data from ODFW. The ODFW mapped fish distribution on 1:24,000 scale USGS topographic maps and transferred the data to a 1:100,000 scale hydrography layer. However, some of the streams found on a 1:24,000 scale map are not found in the 1:100,000 scale hydrography. These non-matching streams are recorded as points representing the upper extent of fish distribution. We created new stream lines for these 1:24,000 scale points.-We have excluded portions of the range of the ESU from the final designation of critical habitat. Exclusions are based on economic and other relevant impacts considered during our analysis, as described in our 4(b)(2) Report. We also excluded Indian lands and Habitat Conservation Plans (HCP). However, due to legal concerns about the disclosure of the location of HCP and Indian lands, as well as questions about the accuracy of the data, we do not identify the location of these exclusions within this data set. Description: These data identify, in general, the areas of PROPOSED critical habitat for Lepidium papilliferum (Slickspot peppergrass).
The US Fish and Wildlife Service is proposing critical habitat for the plant species Lepidium papilliferum (slickspot peppergrass). This shapefile delineates the proposed critical habitat, all in southwestern Idaho. USFWS based this delineation on element occurrence (EO) polygons for the species provided by the Idaho Conservation Data Center. Critical habitat boundaries were initially determined based on the delineation of EO areas ranked either B or C (e.g. BC and CD were included) (at the time of listing. We chose to use an approximately 820.2 feet (ft) (250 meter (m)) buffer around delineated EOs to incorporate sufficient additional habitat to support pollinators of Lepidium papilliferum in occupied slickspots, as well as provide a buffer to protect L. papilliferum from ground disturbing activities such as development and recreation. The areas proposed as critical habitat will ensure maintenance and continuity of foraging habitats for insect pollinators adjacent to occupied slickspots, which helps to increase seed viability and production and is essential for maintaining genetic diversity in the species over the long term. Additionally, the native sagebrush-steppe habitats buffer L. papilliferum from wildfire and nonnative plant invasions, and help to maintain local ecosystem characteristics within the larger landscape, which are crucial for protecting the species and its seed bank. The seed bank is an essential feature of L. papilliferum's biology because it buffers the species from stochastic impacts and variation in environmental conditions.
Using GIS, we intersected the 820.2 ft (250 m) buffered EOs with a quarter quarter section shapefile (ladesc) based on the Public Land Survey System (PLSS). Quarter quarter sections that contained delineated EOs and surrounding buffers were initially identified as proposed critical habitat. We chose this strategy for several reasons: (1) quarter quarter sections are the most common minimum size and method for delineating land ownership boundaries within the range of Lepidium papilliferum, (2) the PLSS is a common method for the public and land management agencies to easily identify proposed critical habitat areas, (3) quarter quarter section boundaries are commonly used for partitioning lands for management purposes such as livestock allotment boundaries, and (4) quarter quarter section descriptions minimize the number of coordinates necessary to define the shapes of the critical habitat units.
We then removed quarter quarter sections with minimal (less than 5 ac (2 ha)) proposed critical habitat as identified by the 870.2 ft (250 m) buffer area, especially along edges of blocks of habitat, while retaining quarter quarter sections within larger blocks of proposed critical habitat to maintain landscape connectivity and reduce fragmentation. Most polygons are intact PLSS polygons, be aware that some (identified using the 'Source' field) were created manually.

Actions that occur outside of EFH, but that might affect the habitat, must also be taken into account. The final rule of "Fisheries Off West Coast States; West Coast Salmon Fisheries; Amendment 18 to the Salmon Fishery Management Plan" was published in the Federal Register / Vol. 79, No. 243/ Thursday, December 18, 2014. Geospatial data was based on information in that document in Table 1 to Part 660, Subpart H - Pacific Salmon EFH Identified by USGS Hydrologic Unit Code (HUC). It pertains to Chinook, coho, and pink salmon. This data is the geospatial representation of the final rule.
