Description: Historic resources surveys shall be performed and documented at sufficient levels to satisfy the SHPO that the requirements of Section 106 of the National Historic Preservation Act are met for determining the presence of and documenting historic properties in the project Area of Potential Effects (APE) and in accordance with 36 CFR 800 and the Antiquities Code of Texas. Findings must be documented per the provisions of TxDOT’s Section 106 Programmatic Agreement (PA) and the Memorandum of Understanding with the Texas Historical Commission (43 TAC 2. Subchapter H). Survey reports must contain sufficient evidence to either justify National Register of Historic Places (NRHP) eligibility determinations for all historic-age resources encountered during field investigations or make a case for conducting an intensive-level survey to finalize the determinations.
