Description: The dust visibility construction notification area defines the regulatory boundary within which construction permits are required for fugitive dust control rules under the regional haze program. This layer was created under the definition of the Dust Visibility Protection Area rule [R18-2-D1301(10)] and the exception for certain PM10 Non-attainment areas [R18-2-D1302(B)]. Please refer to the official rules [R18-2-D1301-1302] and additional resources for more detailed information about the regulatory requirements. The layer is owned by the Air Quality Improvement Planning Section.

This layer was derived from the BLM's PLSS Township polygon data for Arizona downloaded from the BLM portal July, 2023. A query was constructed based upon the Township and Range specified in the rule and was used in the select by attribute tool. Native American Reservation and Off-Reservation Land Trust boundaries sourced from the U.S. Census Bureau were then removed from the selection. Exclusion areas within the PM10 non-attainment area defined by [R18-2-D1302(B)] (i.e., the western-most PM10 boundaries within Maricopa and Pinal Co.) were also removed from the selection. A final clean up of polygon slivers was performed to account for shape discrepancies resulting from layer reprojection (All layers involved in geoprocessing were projected to Nad83 Zone12 N [26912]).
