Description: To facilitate the processing of applications and the taking
of claims on public lands, the State Engineer has adopted a policy which allows
agencies administering public lands to file one Water Users Claim (WUC) per
subdrainage basin in areas involved in a general water rights adjudication or
one Diligence Claim @C) per subdrainage basin in areas not actively being
adjudicated. These claims can be filed to cover all the water sources for all
the agency's livestock and wildlife watering purposes within a subdrainage
basin. The claims must be based on historically established rights where the
water use wi$ initiated prior to and continued consistently after the
enacfinent of the Utah water law goveming the use. This policy makes no attempt
to quantiff or identiff federal reserved rights associated with public lands
but rather its purpose is to reflect actual usage of water as established under
Utah law. In a general adjudication of water rights, the WUC can be prepared to
also include the agency's other water rights in the subdrainage basin which are
used for purposes other than livestock and wildlife watering. These other water
rights retain their individual status in all aspects of their characteristics
(point of diversion, place of use, period of use, priority date, etc.). In this
way, in addition to confirming the livestock and wildlife watering rights, the
WUC is a means of organizing all of the agency's water rights within the
subdrainage basin into one document for the purposes of the adjudication. The
WUC document itself is computer generated by the Division of Water Rights from
information in the water rights files and from information provided by the
